Vinson” as Chief Justice, 8¼x3. Ashland, Kentucky, 1949 December 13. Check No. 249-49 drawn on Vinson’s personal account at First National Bank of Louisa, Kentucky, payable to Lewis & Thos. WILLIAM J. BRENNAN JR. – TYPED SYLLABUS SIGNED CIRCA 1977
HistoryForSaletm Autographs & Manuscripts Make an Offer Today and Get a Quick Response! Take a Look at This Week’s Specials! See Our Low/No Reserve Auctions – Ending Soon! ASSOCIATE JUSTICE WILLIAM J. BRENNAN JR. – TYPED SYLLABUS SIGNED CIRCA 1977 – HFSID 84228 WILLIAM J. BRENNAN, JR William J. Brennan, Jr. signs a typed syllabus of the court’s opinion on “Roth v. United States and Alberts v. California”. Typed Syllabus signed: “Wm J Brennan Jr” at conclusion (page 6), 6p, 8½x11. Associate Justice Brennan delivers the Court’s opinion on “Roth v. United States and Alberts v. California” regarding the protection of obscenity under the First and Fourteenth Amendments. Circa 1977. In part: “These two cases, decided together, involved convictions for violating in one instance a federal statute providing that obscene, lewd, lascivious, filthy, or indecent material is nonmailable, and in a second, a California statute punishing one who wilfully (sic) and lewdly writes or otherwise produces obscene or indecent material or who advertises such material. The portions of the opinions included below deal with issues of free speech and free press and that of unconstitutional vagueness…The dispositive question is whether obscenity is utterance within the area of protected speech and press. Although this is the first time the question has been squarely presented to this Court, either under the First Amendment or under the Fourteenth Amendment, expressions found in numerous opinions indicate that this Court has always assumed that obscenity is not protected by the freedoms of speech and press….” Concludes: “In summary, then, we hold that these statutes, applied according to the proper standard for judging obscenity, do not offend constitutional safeguards against convictions based upon protected material, or fail to give men in acting adequate notice of what is prohibited….” William J. Brennan, Jr. (1906-1997), appointed Associate Justice by President Eisenhower, served from October 6, 1956 until his retirement on July 20, 1990. He believed that only by making the Constitution a “living document” could America’s system of government keep up with the needs of society — in direct opposition to the “strict constructionist” approach of conservative colleagues such as Justices Rehnquist and Scalia. Creased at lower left blank corners. Staple holes at upper left blank corner. Lightly soiled. Show through of pencil note (unknown hand) at upper margin of signature page. Original 1973 Landmark RARE Slip Opinion ROE v. WADE – Abortion US Supreme Court
Decided January 22, 1973, Roe v. Wade was a landmark decision of the U.S. Supreme Court in which the Court ruled that the Constitution of the United States protects a pregnant woman’s liberty to choose to have an abortion without excessive government restriction. This listing is for an original copy of that opinion obtained directly from the Supreme Court including all separate writings and dissents. It also includes the companion case out of Georgia, Doe v. Bolton, issued on the same day. These are scarce and very rare copies of the Supreme Court’s cases. They were obtained directly from the Court in 1973, and held in a family collection until now. Condition is great–slight discoloration to the paper the opinion is printed on; a slight fold to the corner of the Doe case.
V. Rare BROWN v BOARD OF EDUCATION Original Issue Supreme Court Opinions Pt 1&2
Brown v. Board of Education of Topeka was a landmark 1954 U.S. Supreme Court case in which the Justices ruled unanimously that racial segregation of children in public schools was unconstitutional. Brown v. Board of Education was one of the cornerstones of the civil rights movement, and helped establish the precedent that “separate-but-equal” education and other services were not, in fact, equal at all. This listing includes both the 1954 opinion, that was reargued the following year, and the 1955 decision. These copies are in near mint condition–some discoloration to the pages–but otherwise perfect. They were obtained directly from the US Supreme Court shortly following the announcement of the cases and kept in a legal file and in a family collection until now.
